Terms of Service

Welcome to gogomobile.com.my (the "Site"), operated by Creative Distributions Sdn Bhd ("we", "us", GOGO Mobile). By accessing or using the Site, our mobile app, or any of our physical outlets for transactions linked to your online account, you agree to these Terms & Conditions. If you do not agree, please do not use our services.

1. Eligibility & account

  • You must be at least 18 years old to make purchases.
  • You are responsible for keeping your login credentials confidential. You are liable for all activity under your account.
  • We may suspend or terminate accounts that violate these terms, attempt fraud, or abuse promotions.

2. Products & pricing

  • All prices are in Malaysian Ringgit (MYR) and inclusive of SST where applicable.
  • We try to keep all product information, images, and stock counts accurate, but errors may occur. We reserve the right to correct pricing or product information and to cancel orders affected by obvious errors.
  • Promotional prices, vouchers, and member discounts are valid only for the period and conditions stated. Stock is limited.

3. Orders & payment

  • Your order is a binding offer to buy. We confirm acceptance by email/in-app notification once payment is verified.
  • Payment is processed by our partner payment gateway and accepted via FPX (online banking), Touch 'n Go eWallet, credit/debit cards (Visa, Mastercard), Cash on Delivery (selected areas), GrabPay, Boost, DuitNow QR, and approved BNPL providers.
  • No customer-side cancellation after payment. Once payment (deposit or full) has been received by us, orders cannot be cancelled by the customer. If you need to cancel a paid order, please contact us directly — cancellation will be at our sole discretion based on order status.
  • Stock unavailability. If we are unable to fulfil your order (for example, stock unavailability), we will contact you first to offer alternatives (different colour, alternative model, restock wait) before processing cancellation. Refunds in those cases follow Section 5 below.
  • We may decline or cancel an order at our discretion (e.g., suspected fraud, payment failure, address outside our delivery zone). Any payment received for an order cancelled by us will be refunded per Section 5.
  • Vouchers are limited to a maximum of 2 per order unless otherwise stated.

4. Delivery & self-pickup

  • Delivery is fulfilled by J&T Express, Pos Malaysia (Poslaju), or our own staff (for self-pickup at any GOGO outlet).
  • Delivery times are estimates and depend on courier capacity, public holidays, and your location within Sabah.
  • Risk of loss passes to you on delivery to the address provided or on collection at the outlet.
  • Self-pickup at outlet. Once your order arrives at your selected pickup outlet, you will be notified via WhatsApp, in-app notification, and email. You must collect your order within 7 days of being notified that it is ready for pickup. Please bring your Order ID to the outlet — no identification card is required.
  • Changing pickup outlet. You may change your nominated pickup outlet only before your order has been shipped from the supplier. Once the order is in transit, the pickup outlet is locked. To change, please contact us as early as possible.
  • Online Exclusive products. Items marked "Online Exclusive" are not held in physical outlet stock and are shipped from our supplier directly to your selected pickup outlet. Expected arrival is 3-7 working days depending on outlet location (Karamunsing branches ~3 days, Tawau ~7 days). You will receive a WhatsApp notification when ready for collection.
  • Deposit forfeiture. For orders paid by deposit only (without full payment), if the order is not collected within 7 days of being marked Ready for Pickup at your selected outlet, your deposit will be forfeited and the order will be cancelled. Forfeited deposits are non-refundable. We will send reminder messages during the 7-day window. If you anticipate difficulty collecting on time, please contact us before the deadline.

5. Returns, exchanges & warranty

  • Brand-new sealed devices follow the manufacturer's warranty. Manufacturer warranty length is shown on each product page.
  • Defective-on-arrival (DOA) devices may be exchanged within 7 days of receipt, subject to inspection and original packaging being intact.
  • Change-of-mind returns are not accepted once the device is activated, unsealed, or registered with the manufacturer.
  • Add-ons (extended warranty, screen protection plans, accidental damage cover) are governed by the specific terms shown at purchase.
  • Trade-in valuations are final once approved and the old device is collected.

Refund timeline (when we cancel an order on our side)

Where we are unable to fulfil an order and cancellation is initiated by us (for example, stock unavailability), refunds will be processed as follows:

  • Online banking / FPX: refunded within 1 working day to your original source bank account.
  • Credit or debit card: refunded within 3 working days to your original card.
  • Manual bank transfer: please reply to our WhatsApp or email with your bank account details (account holder name, bank name, account number); refund will be processed within 3 working days of receiving these details.

Refunds may take an additional 1-3 working days to reflect in your account depending on your bank's processing time.

6. Membership, points & vouchers

  • Membership tiers (Silver, Gold, Platinum) are awarded based on cumulative qualifying spend. Points and vouchers are non-cash, non-transferable, and have no monetary value outside our platform.
  • Vouchers are valid only within their stated period, subject to minimum purchase, usage limits, and tier eligibility shown on the voucher.
  • We may revoke points or vouchers obtained through abuse, fraud, or system error.

7. Intellectual property

All content on the Site — text, graphics, logos, product images, and software — is owned by GOGO Mobile, our affiliates, or our licensors and is protected by copyright and trademark laws. You may not copy, modify, or redistribute it without prior written permission.

8. Acceptable use

You agree not to: use the Site for unlawful purposes, attempt to access other users' accounts, scrape or reverse-engineer the platform, introduce malicious code, or abuse promotions through automation or fake accounts.

9. Limitation of liability

To the maximum extent permitted by law, our liability arising from any order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses (e.g., loss of data, loss of profits) arising from use of the Site.

10. Privacy

Your personal data is handled in accordance with our Privacy Policy, which forms part of these terms.

11. Changes to these terms

We may update these terms from time to time. The "Last updated" date reflects the latest version. Continued use of the Site after changes are posted constitutes acceptance.

12. Governing law

These terms are governed by the laws of Malaysia. Any dispute shall be submitted to the exclusive jurisdiction of the courts of Sabah, Malaysia.

12B. Online Exclusive Items — Special Terms

Some products on Gogo Mobile are marked as "Online Exclusive" (🚚 badge). The following terms apply specifically to these items:

  1. Delivery timetypically 3-7 working days. The supplier ships directly to you, or to your selected pickup outlet.
  2. No cancellation after paymentonce payment is made, orders cannot be cancelled. If the supplier truly cannot fulfill due to genuine stock unavailability, our team will contact you for a full refund.
  3. Pickup outlet changesallowed only before the supplier has shipped the item. Once shipped, the pickup location is locked.
  4. Pickup deadline7 days from notification of arrival at the outlet. For deposit-paid orders, deposit will be forfeited if not collected within this period (see Section 4). After this period the item may be returned to the supplier.
  5. Collectionplease bring your Order ID. No identification card is required.
  6. Warrantystandard manufacturer warranty applies.
